Collections- Small claims case?!?

I'm looking for quick advice from a lawyer or someone who works for a collections agency.

My husband sold a car to a coworker, who failed to turn in the proper paperwork to the DOL (so there is no legal evidence,) We DO however have a copy of sale agreement, (which again, was never turned into DOL so the collections/towing bills are on us -2,000 dollars worth). We ALSO have a towing bill which says the car was abandoned at the address matching his residence on the sale paper.
AND a witness statement from his apt. manager (same address as sale paper).

I am sure we are going to be able to get our money from him in a small claims course. However, since these things take time we'll have to pay the collections by then. Once we win, will it still have affected our credit since we paid collections?! How does that work?!?!?! PLEASE help!

courtney, if you have a bill of sale, you no longer own the car. That bill of sale is just that, for YOUR records. You dont have to turn it in. What happened to the title to the car? Didnt you guys sign the back of it too? Even if you didnt do that, they have a bill of sale and then it is no longer your problem. If the tow company decides to sue you for the money, go to court and provide the bill of sale, witnesses to this sale if possible and then it is not your problem.

but as for your question, no, it shouldnt if you paid the collection. But I wouldnt pay the collection, its not YOUR car anymore. They might sue you and put it on your credit report, but if that is the case, contact your credit reporting agencies, give them a copy of the bill of sale and the order of the court. You see, on a credit report, there might be a bad entry, but you have the opportunity to dispute it or provide additional information as to why this entry is incorrect. I know, it is ridiculous as I feel this credit report stuff is only a conspiracy so you will have to pay more if you get a loan as ANYONE can put negative stuff on your report, correct or not.
