Your Answer: In California right now there is ongoing litigation regarding CHRB Rule 1663 (Entry of Claimed Horse). Specifically, horse owner Jerry Jamgotchian filed suit against the CHRB over CHRB Rule 1663, Subsection B, which states: "A horse claimed out of a claiming race is not eligible to race in any state other than California until 60 days after the close of the meeting from where it was claimed except in a stakes race." Jamgotchian claimed that this rule violated the federal Interstate Commerce Act. This provision makes it unattractive for people to claim California horses for the purpose of taking them to a track out of state. (Colloquially the restrictions on claimed horses are known as being "in jail.") The "jail time" restrictions offer trainers and owners of claiming horses some protection and make them more willing to enter horses in claiming races. Without them, out-of-state raiders can send in a horse to run at a California meet (a "policeman") to make them eligible to claim, and then claim horses here and take them out-of-state without restrictions.
